RYAN TRAVEL

(“RYAN TRAVEL”, “we”, “us” or “our”)
  1. ACCEPTANCE OF THESE TERMS

By making a booking or using any service provided by RYAN TRAVEL, whether in person, by telephone, email, online or through any other booking channel, you confirm that you have read, understood and agree to be bound by these Terms & Conditions.

These Terms & Conditions apply to all bookings and services arranged by RYAN TRAVEL.

Where a booking is made on behalf of other passengers, the person making the booking confirms that they have the authority to do so and accepts these Terms & Conditions on behalf of all passengers included in the booking.

By proceeding with a booking, making a payment, accepting an itinerary or ticket, authorising a change or reissue, or otherwise instructing RYAN TRAVEL to provide a service, you acknowledge your acceptance of these Terms & Conditions.

  1. OUR ROLE AS A TRAVEL AGENT

RYAN TRAVEL provides travel booking and advisory services and acts primarily as an agent or intermediary for airlines, hotels, tour operators, cruise companies, travel insurance providers, visa providers, ticketing consolidators and other third-party travel suppliers (“Third-Party Providers”).

Your contract for the actual travel product or service is generally with the relevant Third-Party Provider.

RYAN TRAVEL does not control the operation, availability, pricing, policies, schedules, performance, safety or service standards of Third-Party Providers.

The terms and conditions of the relevant airline, supplier, consolidator, hotel, cruise company, tour operator, insurer or other provider also apply to your booking.

  1. BOOKINGS MADE ON BEHALF OF OTHER PASSENGERS AND MINORS

The person making a booking on behalf of other passengers confirms that they have the authority to provide instructions and accept these Terms & Conditions on behalf of all passengers in the booking.

If you make a booking for a person under 18 years of age, you confirm that you have the necessary authority as their parent or legal guardian to make the booking and accept these Terms & Conditions on their behalf.

Travel arrangements for minors, including unaccompanied minors, are subject to the requirements of the relevant airline, hotel, tour operator or other Third-Party Provider.

  1. BOOKINGS, AVAILABILITY AND ACCURACY

All bookings are subject to availability and confirmation by the relevant Third-Party Provider.

Prices, fares, taxes, schedules, seat availability and other booking conditions may change until the booking has been confirmed and, where applicable, the ticket or travel document has been issued.

You are responsible for providing accurate passenger information, including full names, dates of birth, passport details and other information required for the booking.

Passenger names must match the relevant travel documents. Name errors, incorrect passenger details or other information supplied by you may result in additional fees, refusal of boarding, cancellation or other consequences for which you may be responsible.

You must carefully check all booking confirmations, itineraries and travel documents immediately after receiving them and notify us in writing of any error as soon as possible.

  1. TICKET ISSUANCE AND PAYMENT

All airfares, taxes, surcharges, fees and other charges are subject to airline availability and may change until the ticket has been issued and payment has been received and cleared.

A fare, seat or reservation is not guaranteed until the applicable ticket or booking document has been successfully issued or confirmed.

Any quotation provided by RYAN TRAVEL may be subject to availability, airline conditions, ticketing deadlines and payment within the stated timeframe.

Airline fares, taxes, surcharges and other charges may change without notice before ticket issuance.

Any increase in the fare, taxes, charges or other costs before ticket issuance will be payable by the customer.

  1. TICKETS ISSUED BEFORE CLEARED PAYMENT

In certain circumstances, RYAN TRAVEL may, at its sole discretion and as a gesture of good faith, issue a ticket before receiving cleared funds.

If full payment is not received in our account within 24 hours of ticket issuance, RYAN TRAVEL reserves the right to cancel the ticket and, where applicable, apply for any available refund or recoverable amount to offset costs incurred in connection with the booking.

The passenger/customer remains responsible for all costs incurred by RYAN TRAVEL as a result of the cancellation or non-payment, including but not limited to:

  • Airline cancellation fees and penalties;
  • Fare losses and fare differences;
  • Taxes and government charges;
  • Ticketing consolidator charges;
  • Supplier charges;
  • Administration fees;
  • RYAN TRAVEL service fees; and
  • Any other applicable costs or charges.

Where a ticket is non-refundable, or where the airline, consolidator or supplier does not provide a refund, the passenger/customer remains liable for the full ticket cost and any other outstanding amount payable to RYAN TRAVEL.

Any refund received, where applicable, may be applied towards the customer’s outstanding balance.

If the amount recovered is insufficient to cover the outstanding liability, the customer remains responsible for the remaining balance.

  1. PAYMENTS AS AUTHORISATION AND ACCEPTANCE

Where a customer has requested a booking, ticket issuance, ticket change, reissue, cancellation, refund or other service and subsequently makes payment of the quoted or requested amount, such payment may be treated as confirmation of the customer’s instruction and acceptance of the applicable charges and conditions.

Where a customer does not provide a written response to an email requesting confirmation but makes payment of the applicable amount, RYAN TRAVEL may rely on that payment as evidence of the customer’s authorisation to proceed.

  1. TICKET CHANGES, REISSUES AND FARE DIFFERENCES

All ticket changes and reissues are subject to the rules, conditions, availability and approval of the relevant airline and/or ticketing consolidator.

A ticket change or reissue may involve:

  • Airline change penalties;
  • Fare differences;
  • Additional taxes;
  • Airport charges;
  • Government fees;
  • Ticketing or consolidator charges;
  • RYAN TRAVEL administration fees; and
  • RYAN TRAVEL service fees.

The exact cost of a change or reissue may not be known until the ticket has been reassessed by the airline and/or our ticketing consolidator.

Any quotation provided by RYAN TRAVEL before final reassessment is indicative only and may change before the ticket is reissued.

  1. TICKETING THROUGH THIRD-PARTY CONSOLIDATORS

RYAN TRAVEL may issue and reissue airline tickets through authorised third-party ticketing consolidators.

Accordingly, the fees, penalties, fare differences, taxes and other charges quoted by RYAN TRAVEL may differ from information provided directly by airline staff, airline websites or other sources.

The final amount payable is determined by the applicable airline, ticketing consolidator and fare conditions at the time of ticket reassessment and reissue.

RYAN TRAVEL is not responsible for differences between information or quotations provided by an airline or another source and the final amount quoted by our ticketing consolidator.

  1. CUSTOMER AUTHORISATION FOR TICKET CHANGES

Where a customer requests a change to a ticket, the customer is responsible for providing clear and accurate instructions regarding the requested passenger(s), travel date(s), flight(s), route(s) and other requested amendments.

Written confirmation may be requested before RYAN TRAVEL proceeds with a ticket change or reissue.

By confirming a requested change, the customer authorises RYAN TRAVEL to proceed with the requested amendment and agrees to all applicable airline, consolidator and RYAN TRAVEL charges.

  1. PAYMENT REQUIREMENTS FOR TICKET CHANGES AND REISSUES

For bookings with a scheduled departure within 72 hours, full payment of all applicable change fees, fare differences, taxes and other charges must be received as cleared funds in RYAN TRAVEL’s account before the ticket change or reissue is processed.

A payment receipt, bank transfer reference, screenshot, verbal confirmation or pending bank transfer does not constitute cleared payment.

The change or reissue will only be processed once the funds have been received and confirmed in RYAN TRAVEL’s account.

For departures more than 72 hours away, RYAN TRAVEL may, at its discretion, provide alternative payment arrangements or proceed before cleared funds are received, subject to these Terms & Conditions.

  1. CHANGES MADE AS A GESTURE OF GOOD FAITH

In certain circumstances, RYAN TRAVEL may, at its sole discretion and as a gesture of good faith, proceed with requested ticket changes before receiving cleared funds.

However, if full payment is not received in our account within 24 hours of the change being completed, RYAN TRAVEL reserves the right to cancel the reissued ticket, subject to airline rules and conditions.

Any costs, penalties, fare losses, taxes, charges, administration fees, service fees or other losses resulting from such cancellation shall remain the passenger/customer’s responsibility.

Where applicable, RYAN TRAVEL may apply for any available refund or recoverable amount to offset costs incurred.

  1. CANCELLATION OF REISSUED TICKET DUE TO NON-PAYMENT

If a reissued ticket is cancelled because payment has not been received within the required timeframe, any subsequent request to reinstate, reissue or rebook the ticket will be treated as a new change or booking request.

The new request will be subject to:

  • Current airline availability;
  • Current fares;
  • Fare differences;
  • Airline penalties;
  • Taxes and government charges;
  • Consolidator charges;
  • Administration fees;
  • RYAN TRAVEL service fees; and
  • Any other applicable charges.

The original fare, flight, date, route, seat or booking conditions may no longer be available.

  1. REVERSING A TICKET CHANGE

If a passenger changes their mind after a ticket has been changed or reissued and requests that the ticket be returned to the original travel date, flight, route or itinerary, the request will be treated as a new ticket change request.

All applicable airline penalties, fare differences, taxes, consolidator charges, administration fees and RYAN TRAVEL service fees will apply.

Returning the ticket to the original itinerary is not guaranteed and remains subject to airline rules, availability and approval.

  1. CANCELLATIONS AND REFUNDS

All cancellations and refunds are subject to the rules and conditions of the relevant airline, supplier, consolidator or other Third-Party Provider.

Some fares and travel products are fully or partially non-refundable and cancellation penalties may be up to 100% of the booking value.

RYAN TRAVEL’s service, booking, administration, amendment, cancellation, refund processing and reissue fees are non-refundable once the relevant service has been provided or the fee has been incurred, except where otherwise required by law.

Refunds are processed only to the extent permitted by the relevant Third-Party Provider.

Refund processing may take 12 weeks or longer, depending on the airline, supplier, consolidator and payment process.

RYAN TRAVEL is not responsible for delays in receiving refunds caused by airlines, suppliers, consolidators, payment providers or other third parties.

  1. TICKET EXPIRY AND VALIDITY

Ticket validity is determined by the applicable airline and fare rules.

Tickets may commonly have validity periods of 3, 6, 11 or 12 months from the date of issue, depending on the airline and fare conditions.

It is the passenger’s responsibility to check the applicable ticket expiry date and submit any change, cancellation or refund request before the ticket expires.

Requests received after ticket expiry may not be accepted or may be subject to additional restrictions.

  1. RYAN TRAVEL SERVICE FEES, COMMISSIONS AND OTHER CHARGES

All RYAN TRAVEL service fees, booking fees, administration fees, amendment fees, cancellation fees, refund processing fees, reissue fees, consultation fees and any other fees charged by RYAN TRAVEL are non-refundable once the relevant service has been provided or the fee has been incurred, except where otherwise required by law.

Any additional fees, charges, penalties or costs incurred in connection with a customer’s booking or requested service are the customer’s responsibility.

These may include, but are not limited to:

  • Airline fees;
  • Supplier charges;
  • Ticketing consolidator charges;
  • Government charges;
  • Payment processing fees;
  • Cancellation fees;
  • Change fees;
  • Reissue fees;
  • No-show fees; and
  • Any other charges imposed by a Third-Party Provider.

RYAN TRAVEL may receive commissions, incentives, overrides or other remuneration from airlines, suppliers, consolidators or other Third-Party Providers.

Such commissions, incentives, overrides or other remuneration do not reduce or offset any RYAN TRAVEL service, administration or other applicable fees payable by the customer.

All RYAN TRAVEL service fees, commissions, incentives, overrides and other remuneration received in connection with a booking are non-refundable unless otherwise required by law.

  1. PASSPORTS, VISAS AND TRAVEL DOCUMENTS

Passengers are solely responsible for ensuring that they hold all documents required for their journey, including:

  • Valid passports;
  • Visas;
  • Transit visas;
  • Electronic travel authorisations;
  • Residence permits;
  • Entry permits;
  • Health certificates; and
  • Any other documents required by the destination, transit country, airline or relevant authority.

Passengers should independently verify current requirements with the relevant government authorities, embassy, consulate and airline.

RYAN TRAVEL may provide general information regarding visa and entry requirements, but such information is provided for guidance only.

Requirements can change without notice.

Passengers must independently verify current requirements with the relevant government authority, embassy, consulate, airline and official travel advisory sources.

  1. RETURN/ONWARD TICKETS AND ACCOMMODATION REQUIREMENTS

Depending on the destination, nationality, visa status and circumstances of travel, passengers may be required to provide evidence of:

  • A valid return or onward ticket;
  • Confirmed accommodation;
  • Sufficient funds;
  • Travel insurance;
  • Proof of purpose of travel;
  • A valid visa or travel authorisation; or
  • Other supporting documentation.

Passengers may be asked to provide evidence of accommodation, a return or onward ticket, or other supporting documents at the departure airport, during transit or upon arrival at their destination.

It is solely the passenger’s responsibility to ensure that they satisfy all such requirements before travelling.

If a passenger is refused boarding, denied entry, refused transit, required to return to their point of origin, or otherwise prevented from completing their journey because they do not satisfy applicable entry, transit, visa, documentation, accommodation, return-ticket or other requirements, RYAN TRAVEL will not be responsible for the resulting loss or expense, except to the extent required by law.

This may include, but is not limited to:

  • New or replacement tickets;
  • Return flights;
  • Accommodation;
  • Meals;
  • Transportation;
  • Visa or permit costs;
  • Airline penalties;
  • Cancellation fees;
  • No-show fees;
  • Fare differences;
  • Taxes;
  • Government charges; and
  • Any other related costs.

The passenger remains solely responsible for all such costs.

  1. REFUSED BOARDING, DENIED ENTRY AND NO-SHOW

Where a passenger fails to travel or board a flight because of a documentation, visa, entry, transit, accommodation, return-ticket or other requirement, the airline may treat the booking as a no-show.

Any applicable no-show fees, cancellation fees, forfeited amounts, fare restrictions or other charges will be the passenger’s responsibility.

If a passenger misses a flight or is refused boarding or entry for any reason within the passenger’s responsibility, RYAN TRAVEL is not responsible for the resulting costs or losses, except to the extent required by law.

Any assistance provided by RYAN TRAVEL in such circumstances is provided subject to availability and the applicable airline and supplier rules and may incur additional RYAN TRAVEL service fees.

  1. HEALTH, MEDICAL AND SPECIAL REQUIREMENTS

Passengers are responsible for complying with all health, vaccination, medical and other requirements applicable to their journey.

Passengers with medical conditions or special requirements should obtain appropriate professional medical advice before travelling.

Requests for special meals, seating, mobility assistance, medical equipment, room requirements or other special arrangements will be passed to the relevant provider where possible.

Such requests are subject to provider approval and availability and cannot be guaranteed by RYAN TRAVEL unless expressly confirmed in writing.

  1. TRAVEL INSURANCE

RYAN TRAVEL strongly recommends comprehensive travel insurance appropriate to the passenger’s circumstances and itinerary.

Travel insurance should consider cover for cancellation, medical expenses, emergency assistance, repatriation, baggage, travel delays and other risks relevant to the journey.

Where travel insurance is arranged through RYAN TRAVEL, the insurance contract is between the passenger and the relevant insurer.

Claims are subject to the insurer’s policy terms, conditions and exclusions.

  1. TRAVEL ADVICE AND TRAVEL RISKS

Passengers should regularly monitor official travel advice and government requirements relevant to their destination and transit points.

We recommend checking the Australian Government’s Smartraveller website before and during travel.

Passengers are responsible for making their own travel decisions based on the most current information available.

Travel involves risks, including delays, cancellations, disruptions, illness, changes in government requirements and other circumstances beyond RYAN TRAVEL’s control.

  1. FLIGHT STATUS, RECONFIRMATION AND CHECK-IN

It is the passenger’s responsibility to regularly check the status of all flights directly with the airline.

We recommend checking the booking through the airline’s “Manage Booking” facility and reconfirming flight details approximately 72–24 hours before departure.

Airlines may change flight times, aircraft, routes, terminals or schedules, or cancel flights.

Passengers are solely responsible for allowing sufficient time for check-in, security, immigration and customs.

As a general guide:

  • Domestic flights: arrive at least 2 hours before departure.
  • International flights: arrive at least 3–4 hours before departure.

Passengers who fail to check in on time or miss a flight may lose the value of the ticket and may be responsible for additional costs and no-show fees.

  1. FLIGHT DISRUPTIONS, TECHNICAL ISSUES, AIRSPACE CLOSURES AND OTHER UNFORESEEN EVENTS

Flights may be delayed, cancelled, suspended or disrupted due to circumstances beyond the control of RYAN TRAVEL or the passenger. Such circumstances may include, but are not limited to, war, armed conflict, airspace closure or restriction, government action, airport closure, severe weather, natural disasters, strikes, technical or operational issues, airline system failures, security incidents or other events affecting airline operations.

If a passenger’s flight is delayed, cancelled, disrupted or affected by a technical or operational issue, the passenger must contact the airline and/or RYAN TRAVEL as soon as reasonably possible to determine the available options.

Depending on the circumstances, the passenger may be required to:

  • Wait for the airline to operate the next available flight;
  • Wait until the affected route or flights resume;
  • Follow the airline’s alternative travel arrangements;
  • Contact RYAN TRAVEL to request a ticket change or reissue; or
  • Request RYAN TRAVEL to arrange an alternative route, where available.

Where a passenger requests RYAN TRAVEL to change or reissue the ticket to an alternative route, date or flight, the request will be treated as a ticket change or reissue and may incur applicable airline penalties, fare differences, taxes, consolidator charges, administration fees and RYAN TRAVEL service fees.

Where the airline or applicable fare rules permit the change without an airline change penalty or other airline charges, the passenger may benefit from such waiver. However, RYAN TRAVEL’s applicable service, administration or processing fees remain payable in all cases, unless RYAN TRAVEL expressly agrees otherwise in writing.

Passengers should not assume that a flight disruption automatically entitles them to a free change, refund or replacement ticket. Any waiver of airline fees, free rebooking, refund or alternative arrangement is subject to the airline’s applicable policy and the conditions imposed by the airline, ticketing consolidator and fare rules.

If a passenger independently purchases a new or replacement ticket from the same airline or from another airline in order to continue their journey, the purchase of that new ticket does not automatically cancel, refund or preserve the value of the original ticket.

The original ticket remains subject to its original fare rules and the applicable airline and ticketing consolidator policies. The original ticket may become non-refundable, may be treated as unused or a no-show, or may have only a small residual or refundable amount, if any, after applicable airline, consolidator and other charges.

Any refund or residual value available from the original ticket will be determined solely in accordance with the applicable airline, ticketing consolidator and fare conditions. RYAN TRAVEL cannot guarantee that any refund, credit or residual value will be available.

Where a passenger purchases a replacement ticket from the same airline or another airline without first obtaining confirmation from the airline or RYAN TRAVEL, RYAN TRAVEL will not be responsible for any additional cost, loss, unused ticket value, missed connection or other expense resulting from that decision, except to the extent required by applicable law.

Passengers are responsible for contacting the airline and/or RYAN TRAVEL promptly when a disruption occurs and for following the applicable airline instructions to protect the value of their ticket and determine the available options.

  1. AIRLINE SCHEDULE CHANGES AND CANCELLATIONS

Airlines may change schedules, flight times, aircraft, routes or cancel flights.

Where a schedule change or cancellation occurs, RYAN TRAVEL may assist the passenger where reasonably possible, subject to the airline’s policies and availability.

Any alternative arrangements, refunds, credits or compensation are subject to the airline’s applicable rules.

RYAN TRAVEL is not responsible for additional costs, accommodation, meals, transport, missed connections, lost income or other losses resulting from airline schedule changes or cancellations, except to the extent required by law.

  1. THIRD-PARTY PROVIDER TERMS

Travel products are subject to the terms and conditions of the relevant Third-Party Provider.

These may include airlines, hotels, tour operators, cruise companies, insurers, ticketing consolidators, visa providers, car rental companies and other suppliers.

By proceeding with a booking, you acknowledge that you may be required to accept the provider’s terms and conditions in addition to these Terms & Conditions.

Where there is a conflict between these Terms & Conditions and mandatory terms imposed by a Third-Party Provider, the provider’s terms may apply to the relevant travel product.

  1. PRICES, TAXES AND FEES

Unless otherwise stated, prices are quoted in Australian dollars (AUD).

Prices may change before confirmation or ticket issuance.

Airline, airport, government, city, fuel, security and other taxes and charges may change.

Any increase applicable before ticket issuance or confirmation will be payable by the customer.

RYAN TRAVEL’s booking, administration and service fees are separate from airline or supplier charges.

Card payment surcharges may apply where applicable.

  1. FORCE MAJEURE

RYAN TRAVEL is not responsible for any failure, delay, disruption, loss or additional expense caused by circumstances beyond our reasonable control.

Such circumstances may include, but are not limited to:

  • Natural disasters;
  • Severe weather;
  • Pandemics or epidemics;
  • Government restrictions;
  • Border closures;
  • War;
  • Terrorism;
  • Civil unrest;
  • Strikes;
  • Industrial disputes;
  • Airline or supplier insolvency;
  • Airport closures; or
  • Air traffic restrictions.
  1. LIABILITY AND DISCLAIMERS

To the maximum extent permitted by law, RYAN TRAVEL’s role is limited to providing booking and advisory services and acting as an intermediary between the customer and Third-Party Providers.

We are not responsible for the acts, omissions, performance, quality, safety, availability, insolvency, delays, cancellations or failures of Third-Party Providers.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under applicable Australian law, including the Australian Consumer Law.

  1. CUSTOMER RESPONSIBILITY

You agree to provide accurate information and comply with the terms and conditions of the relevant Third-Party Providers.

To the extent permitted by law, you are responsible for costs, losses, penalties, fees or liabilities incurred by RYAN TRAVEL as a result of:

  • Incorrect information supplied by you;
  • Failure to provide required travel documents;
  • Failure to comply with airline or supplier conditions;
  • Failure to meet visa, entry, transit or accommodation requirements;
  • Unauthorised or incorrect instructions;
  • Failure to make required payments;
  • Changes or cancellations requested by you; or
  • Other matters within your reasonable control.

This clause does not exclude or limit any rights you may have under the Australian Consumer Law.

  1. MONIES PAID TO RYAN TRAVEL

Unless otherwise required by law, monies paid to RYAN TRAVEL become our property and are not held on trust for the customer.

Funds may be used to pay airlines, suppliers, consolidators or other service providers in connection with the customer’s booking.

  1. PRIVACY

RYAN TRAVEL handles personal information in accordance with our Privacy Policy and applicable privacy laws, including the Privacy Act 1988 (Cth).

By making a booking, you consent to the collection, use and disclosure of personal information as reasonably required to arrange and administer your travel services.

Information may need to be disclosed to airlines, hotels, insurers, consolidators, visa providers, government authorities and other Third-Party Providers, including overseas providers, where necessary to provide the requested services.

  1. CHANGES TO THESE TERMS

RYAN TRAVEL may update these Terms & Conditions from time to time.

Unless otherwise required by law, the version of the Terms & Conditions applicable at the time the booking is made will apply to that booking.

The current version will be published on our website.

  1. GOVERNING LAW

These Terms & Conditions are governed by the laws of New South Wales, Australia.

Subject to any mandatory rights or jurisdictional requirements under applicable law, you agree to submit to the jurisdiction of the courts of New South Wales.

  1. GENERAL

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the extent necessary, and the remaining provisions will continue to apply.

A failure by RYAN TRAVEL to enforce any provision of these Terms & Conditions does not constitute a waiver of that provision.

These Terms & Conditions, together with any applicable Third-Party Provider terms and any written booking conditions provided to you, constitute the terms applicable to the services arranged by RYAN TRAVEL.

  1. CUSTOMER ACKNOWLEDGEMENT

By proceeding with a booking, making a payment, accepting a ticket or itinerary, authorising a change or reissue, or otherwise instructing RYAN TRAVEL to provide a service, you acknowledge that:

  • You have had the opportunity to read these Terms & Conditions;
  • You understand and accept these Terms & Conditions;
  • You understand that RYAN TRAVEL acts primarily as a travel agent and intermediary;
  • You accept the applicable airline, supplier and Third-Party Provider terms;
  • You accept responsibility for providing accurate information and required travel documents; and
  • You agree to pay all applicable fares, taxes, penalties, supplier charges, consolidator charges, administration fees and RYAN TRAVEL service fees applicable to your booking or requested services.

By proceeding with any booking or using our services, you confirm your acceptance of these Terms & Conditions.
